The International Criminal Court (ICC) took a historic decision early this month. said on February 5 that the court has jurisdiction over war crimes committed in the Palestinian territories, a ruling that was welcomed by Palestinians and criticized by Israel.
According to this ruling, the ICC would have jurisdiction to investigate potential war crimes commited in Palestinian territories.
Professor Ilan Binyamin Pappe, a lecturer in the College of Social Sciences and International Studies at the University of Exceter in the United Kingdom welcomed that decision. "Symbolic at least, framing correctly the abuses of the Palestinian civil and human rights as war crimes given the years of international immunity Israel enjoyed," he said in an exclusive interview with Faisal Assegaf from Albalad.co via email today.
Pappe hopes the newly chosen Chief Prosecutor of the ICC Karim Ahmad Khan will move forward to investigate and interrogate as a first stage. He will assume office on June 21, to replace Fatou Bom Bensouda.
Have you expected the historical decision by ICC on Friday last week?
Yes, this is a decent body and this is why it is opposed by both Israel and the USA. And this action was a long process in the making.
Are you sure the ICC will probe war crimes committed by Israel during Hamas-Israel war in 2014?
You can never know as the pressure would be enormous. But judging its action in the past, I really hope they will not cave in.
According to you, which side committed war crimes, Israel or Hamas or both side?
The war crimes were committed by Israel to my mind.
If the ICC later investigated and decided Israel committed war crimes against Palestinians, do you believe the ICC will try Netanyahu and Israeli generals?
I doubt whether Netanyahu will be tried. We are also far away from the trial. Let see if they begin to investigate and interrogate as a first stage.
What is your expectation from the ICC decision?

Do you think the Palestinian elections will be succcessfully held? If so or no, please explain.
Hard to tell. I am not sure that elections under occupation can be properly held and there is a whole question of the deteriorating legitimacy of the Palestinian Authority in a growing number of Palestinian sectors. So I do not expect corruption of irregularities, but I am not sure the process can easily be processed.
Do you believe Hamas will win in one or both elections?
It will do very well, I am not sure about winning, but a good result for sure
Can you elaborate what factors will make Hamas and Fatah should win the elections?
Both suffer from their constant inner fighting between themselves. So what one should look for is actually to see if the younger generation of Palestinians, which is half of the population, will treat the two parties and the more independent candidates.
